In these terms, “Pure Gloss”, “we”, “us” and “our” refer to Pure Gloss Ltd.

2. About these terms

These Terms and Conditions of Sale apply when you purchase products from puregloss.co.uk.

Please read them before placing an order. They explain who we are, how orders are accepted, how products are delivered, your cancellation and return rights, and what to do if there is a problem.

Nothing in these terms limits or excludes any legal rights available to consumers.

A “consumer” is an individual purchasing products wholly or mainly for purposes outside their trade, business, craft or profession.

A “business customer” is anyone purchasing products wholly or mainly for use in a trade, business, craft or profession.

3. UK sales only

We currently accept orders only for delivery to addresses within the United Kingdom that are accepted at checkout.

We may be unable to deliver to certain postcodes, islands, offshore locations or restricted areas where our courier cannot safely or lawfully transport the product.

We do not currently offer international delivery.

4. Product information

We take reasonable care to ensure that product descriptions, photographs, prices and other information are accurate.

Product photographs are for illustrative purposes. Packaging, labels, applicators or accessories may differ slightly from photographs where this does not materially affect the product.

The colour of a product or finish shown on a screen can vary depending on the device and display settings.

Product performance depends on matters including surface condition, preparation, application technique, temperature, humidity, curing conditions, maintenance and exposure. Results may therefore vary.

Any coverage, curing, durability, hardness, gloss, water behaviour or performance figures are estimates or test-based claims subject to the conditions and limitations stated on the product page, label, application guide and supporting technical information.

A ceramic coating is not scratch-proof, stone-chip-proof or maintenance-free unless we expressly state otherwise.

5. Product availability

Products are subject to availability.

An item being displayed on the website does not guarantee that it remains available when an order is placed.

If we cannot supply a product, we will contact you and refund any amount paid for that product.

We will not substitute a materially different product without your agreement.

6. Placing an order

You are responsible for checking your order, delivery details and contact information before submitting it.

After you place an order, we will normally send an order acknowledgement email. This confirms that we have received your order but does not necessarily mean that we have accepted it.

Our acceptance of your order takes place when we send a dispatch confirmation or otherwise confirm that the product has been dispatched.

A contract between you and Pure Gloss is formed when we accept the order.

We may reject or cancel an order before dispatch where:

  • the product is unavailable;
  • payment has not been authorised;
  • there is an obvious pricing or description error;
  • we reasonably suspect fraud or unauthorised payment;
  • delivery is unavailable to the supplied address;
  • the order breaches a purchase restriction displayed on the website; or
  • fulfilling the order would breach a legal, safety or courier requirement.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item.

7. Prices and payment

Prices are shown in pounds sterling.

Prices include VAT where VAT is applicable. If Pure Gloss Ltd becomes VAT registered, the VAT registration number will be displayed where legally required.

Delivery charges and any other unavoidable charges will be shown before you submit the order.

We accept the payment methods displayed at checkout.

Payment is normally taken when the order is placed or authorised. Payment processing may be carried out by a third-party payment provider.

You confirm that you are authorised to use the payment method supplied.

8. Obvious pricing errors

We try to ensure that prices are correct.

If an obvious and unmistakable pricing error occurs and could reasonably have been recognised as an error, we may cancel the order and refund the amount paid.

We will not increase an agreed price after an order has been accepted unless the change is required by law and you agree to it where agreement is required.

9. Delivery

Delivery arrangements are explained in our Delivery Policy.

Unless a different period is agreed with you, we will deliver products without undue delay and no later than 30 days after the contract is formed.

Estimated dispatch and delivery dates are estimates unless we expressly agree that a particular date is guaranteed.

Delivery is completed when the product is delivered to:

  • the address supplied in the order;
  • a safe place authorised by you;
  • a neighbour authorised by you; or
  • another person identified by you to receive it.

You are responsible for providing a complete and accurate delivery address.

10. Risk and ownership

The product becomes your responsibility when it is delivered to you or to a person or place authorised by you.

Ownership of the product passes to you when we have received payment in full and the product has been delivered.

11. Changing or cancelling an order before dispatch

Contact sales@puregloss.co.uk as soon as possible if you need to change or cancel an order.

We cannot guarantee that a change or cancellation can be made after an order has entered the dispatch process.

If an order has already been dispatched, you may still have the right to cancel and return it under our Returns, Cancellations and Refunds Policy.

12. Consumer cancellation rights

Most consumers purchasing online have a legal right to change their mind.

You normally have 14 days after receiving the product to tell us that you wish to cancel.

After notifying us, you normally have a further 14 days to return the product.

13. Faulty, damaged or misdescribed products

Products must be as described, of satisfactory quality and fit for any particular purpose that we have agreed with you.

Contact sales@puregloss.co.uk if a product is faulty, damaged, incorrect, incomplete or not as described.

Your legal remedies may include a refund, repair or replacement depending on the circumstances and how long you have had the product.

Photographs of the product, packaging and shipping label can help us investigate damage or an incorrect delivery, but requesting photographs does not remove your statutory rights.

14. Safe use of chemical products

You must read the product label, application instructions and safety information before opening or using the product.

Where a Safety Data Sheet is provided, it should be read alongside the product label and application guide.

You are responsible for:

  • checking that the product is suitable for the intended surface and use;
  • following all application, ventilation, personal protective equipment, storage, disposal and safety instructions;
  • carrying out a small test in an inconspicuous area where appropriate;
  • keeping the product away from children and animals;
  • preventing unauthorised use;
  • not mixing the product with other substances unless expressly instructed;
  • protecting the product from unsuitable temperatures and storage conditions; and
  • stopping work and seeking advice if the product behaves unexpectedly.

Do not use a product where its packaging is damaged, leaking, unsealed unexpectedly or materially different from the product ordered. Isolate it safely and contact us.

General website guidance does not override the product label or current Safety Data Sheet.

15. Application results

Preparation and application have a significant effect on ceramic-coating performance.

We are not responsible for a poor application result caused by matters outside our reasonable control, including:

  • inadequate cleaning or decontamination;
  • unsuitable polishing oils or residue;
  • failure to prepare the surface correctly;
  • application in unsuitable temperature, humidity or ventilation;
  • excessive or insufficient product application;
  • failure to level the coating correctly;
  • water exposure or contamination during curing;
  • incompatible chemicals, toppers or maintenance products;
  • application to an unsuitable or damaged surface; or
  • failure to follow current instructions.

This section does not exclude responsibility for a defective, unsafe or misdescribed product.

16. Manufacturer warranties and guarantees

Any product warranty or guarantee offered by us will be described separately.

A warranty or guarantee is additional to, and does not replace, a consumer’s statutory rights.

A durability statement is not an unconditional guarantee that a coating will remain in the same condition for the entire period. Performance depends on preparation, use, environment and maintenance unless the warranty expressly states otherwise.

17. Our responsibility to consumers

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed.

We do not exclude or limit responsibility where it would be unlawful to do so, including responsibility for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot legally be excluded; or
  • breach of statutory consumer rights.

We supply products to consumers for private use. We are not responsible to a consumer for business losses, including loss of profit, revenue, business opportunity or business interruption.

18. Business customers

If you purchase wholly or mainly for business use, the statutory consumer cooling-off period does not apply.

Nothing in these terms excludes liability that cannot legally be excluded.

Subject to that restriction, we will not be liable to a business customer for indirect or consequential loss, loss of profit, loss of business, loss of revenue, loss of anticipated savings or business interruption.

Our total liability to a business customer arising from an affected order will not exceed the price paid for the affected products, except where a higher liability cannot legally be limited.

Business customers are responsible for carrying out their own workplace risk assessments and complying with applicable health and safety, COSHH, storage, transport and disposal requirements.

19. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control.

These may include severe weather, courier disruption, transport restrictions, fire, flood, industrial action, failure of communications networks, government action, shortages or legal restrictions.

We will take reasonable steps to reduce the effect of the event and will contact you where a material delay affects your order.

Your legal rights relating to delayed or failed delivery remain unaffected.

20. Website content and intellectual property

The Pure Gloss name, branding, website design, photographs, written guides, graphics, product descriptions and other content are owned by or licensed to Pure Gloss Ltd unless stated otherwise.

You may use the website for personal shopping and information.

You must not reproduce, republish, sell, commercially exploit or systematically copy website content without permission.

21. Reviews and user content

Where you submit a review, photograph or other content, you confirm that:

  • it is accurate and based on genuine experience;
  • you have the right to submit it;
  • it does not infringe another person’s rights;
  • it is not unlawful, abusive, threatening or misleading; and
  • it does not contain malicious software or confidential personal information.

You grant us a non-exclusive, royalty-free permission to display and reproduce submitted content for operating and promoting Pure Gloss.

We may remove content that breaches these requirements.

We will not suppress a genuine negative review merely because it is negative.

22. Personal information

We handle personal information in accordance with our Privacy Notice and Cookie Policy.

23. Changes to these terms

We may update these terms from time to time.

The terms applying to your order will normally be those made available when the order was placed, unless a change is required by law.

24. If part of these terms is invalid

If any part of these terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

25. Third-party rights

These terms are between you and Pure Gloss Ltd.

No other person has a right to enforce them except where the law expressly provides otherwise.

26. Governing law

These terms are governed by the laws of England and Wales.

Consumers living in Scotland or Northern Ireland retain any mandatory protections available under the law applying where they live.

A consumer may bring legal proceedings in the courts available under applicable consumer law.
